Court of Appeals Affirms Lease Award

On March 17th, 2021, the Oregon Court of Appeals published its decision in Sky Lakes v. Oregon DHS. The lawsuit challenged the award of an Oregon Department of Human Services lease for a build-to-suit regional facility in Klamath Falls. The lease was awarded to Rubicon Investments’ subsidiary, Klamath Falls Holdings, LLC, on March 27th, 2018 and the decision has been challenged by Sky Lakes through various avenues since the award. In the 22-page opinion, the court walked through how the state properly conducted itself during the process and affirmed the dismissal of the Klamath County Circuit Court.
